The case of Jason Menzies from Australia is one example of such a case.  Mr Menzies was left with permanent brain injuries after he was the victim of an assault in 2009.  Although his attacker only landed one punch, he hit his head on the floor, knocking him unconscious.  He fractured his skull in the attack, as well as suffering bleeding on the brain, frontal lobe damage and a loss of his sense of smell.

Mr Menzies was awarded $75,000AUD in compensation (£49,000) for his injuries; however his medical bills ran into hundreds of thousands of dollars.  A statement by Mr Menzies personal injury solicitor, Michelle Howley :

“Mr Menzies has permanent physical, sensory, cognitive and psychological impairment.  He is hundreds of thousands of dollars out of pocket for medical bills and past and future lost earnings.  We see so many clients who suffer brain injuries, through no fault of their own, and because of the current laws they get little compensation.”

The case of Mr Menzies highlights the importance of compensation for brain injury claims not being a set amount, but instead covering the real world expenses an individual incurs when they are in an accident or the victim of an attack.

However, this also highlights the fortune of those living within the UK, who may take for granted the ease of being taken to hospital, treated and cared for without the pressure of facing huge medicals bills at the end of their ordeal.
