Under the Fatal Accidents Act 1976, if the accident has been caused by the negligence of another motorist then dependents of the deceased such as a spouse, child or elderly parent may be able to make a claim for compensation.

For fatal road accidents after the 1st January 2008 a one-off bereavement award of £11,800 can be claimed. This can only be claimed by spouses, legitimate children (aged 18 or under) of the deceased, parents of a legitimate child and the mother of a deceased child who was illegitimate. A claim may also be made for reasonable funeral expenses, the loss of financial contribution of the deceased and the loss of non-financial contribution. (E.g. DIY, Childcare and other assistance the deceased provided to their family.)
