Magician Makes £15,000 Arm Injury Claim
A close-up magician has made an arm injury claim for compensation for £15,000 after doctors failed to diagnose a severed tendon.
Kyle Summers, a successful magician, thought that his career had been ruined after the severed tendon meant that he was unable to move his thumb. He commented:
“Suffering even the slightest hand impairment is an absolute nightmare for any magician. I would hate anyone else to find themselves in my position simply because a medic missed something as relatively straightforward as a severed tendon.”
Beth Nunnington has more on this story…
Mr Summers sustained the injury when he was cleaning a cup that shattered in his hand. The 40-year-old went to George Eliot Hospital for treatment. Although medics took an X-ray to ensure there was no china lodged in his left thumb, they did not check to see if the tendon was damaged.
The problem was not spotted until six weeks later, by which time the tendon was beyond repair. Mr Summers required two further operations to correct the damage with a rod inserted to re-open the carpal tunnel in his wrist with a thicker tendon attached to help aid recovery.
Arm Injury Claim Made To Cover Loss Of Earnings
Mr Summers has previously performed magic for film director Michael Winner and Lord Chancellor Lord McKay, but as a result of the misdiagnosis he required months of physiotherapy before he was able to perform again. He also had to relearn how to perform one of his key tricks-the overhand shuffle.
The George Eliot NHS Trust settled Mr Summers claim out of court for the sum of £15,000. His solicitor commented on the settlement:
“Kyle is a hugely talented individual and it would have been a tragedy if the injury had a long-term impact on his ability to perform.”
When asked about the settlement the George Eliot Hospital said that it did not comment on individual settlement cases.
