Brain Injury Compensation – £3.35million Awarded
A 25-year-old man has finally received brain injury compensation after he claimed that medical mistakes during his birth caused him to suffer from cerebral palsy.
Adam Spinks’ legal team claimed that staff at Fairfield Hospital in Bury made mistakes that led to Mr Spinks being starved of oxygen at birth, causing him to suffer from disabilities.
The North West Strategic Health Authority, which is responsible for Fairfield Hospital, has never admitted liability for the incident but has agreed to settle the matter by paying half of the full value of the compensation claim.
The brain injury compensation will now help to pay for Mr Spinks’ house to be adapted as well as the provision of 24-hour-care.
Brain Injury Compensation – Mother Hopes Claim Will Improve Care For Pregnant Women
Adam’s mother Jacqueline commented on the settlement. She said:
“The past 24 years have been incredibly difficult for the family and we have some tough times ahead, but to know that we have the means to be able to support Adam is an immense relief.
“However, we don’t want any other families to go through the same situation, so we hope that Adam’s case will demonstrate the devastating effects that birth injuries can have and improve levels of care for pregnant women.”
The legal team representing Mr Spinks added that ‘no amount of money will substitute for the ability to lead a full and normal life’, but hoped that the compensation settlement will help to ‘make his life as comfortable as possible’.
An NHS spokesperson for the North West commented on the final settlement:
“The parties worked together to reach a financial settlement, which has now been approved by the court. The Strategic Health Authority would like to wish Adam and his family well for the future.”
