Medical Negligence

Medical Negligence Can Include Misdiagnosis

Medical Negligence : Misdiagnosis can have significant consequences

If you believe that you have suffered from inadequate medical treatment, delaying your recovery, or even causing you to suffer further injury or illness, then you may be entitled to make a claim for medical negligence compensation.

Attending hospital or your general practitioner can be a stressful time for you and your family without having to worry about the standard of treatment that you are receiving. If you have suffered as a result of a medical mistake then you may be entitled to compensation.

Duncan Gibbins Solicitors will be able to discuss your potential claim in further detail, there will be no obligation on your part and we can fund your claim by way of a no win, no fee agreement.

What Is Medical Negligence Compensation?

A claim for compensation may be made if the treatment and care provided during your stay in hospital fell below the standard of care required by the medical industry.

Mistakes made during diagnosis, treatment, and aftercare can significantly affect the future quality of life of a patient. In some cases, a medical mistake can prove to be fatal. That is why medical professionals are required to provide the highest possible standard of care.

Examples of medical negligence can include:

• Misdiagnosis of an injury or illness

• Failure to refer a patient for further treatment

• Mistakes made during surgery

• Incorrect medical prescription

• The use of faulty medical equipment that causes injury

• Failing to control an infection in hospital

This list is by no means definitive and it is advisable to contact a specialist medical negligence solicitor if you believe that you suffered inadequate medical treatment that has caused you further suffering or delayed your recovery.

Medical Negligence In The News

In May 2011 the NHS paid more than £4million in compensation to Tahlia Jade Downes, now 15, after she was starved of oxygen during her birth.

As a result of the complications at the Norfolk and Norwich hospital, the teenager has been left with severe mental and physical disabilities, cerebal palsy, and will be wheelchair-bound for the rest of her life.

Tahlia’s mother Jade pursued a claim for medical negligence against the NHS who alleged that the complications were caused by medics who failed to carry out a ceasaren section during the birth.

Although the NHS have denied any negligence they felt that Tahlia should be compensated.

The sum of compensation will now be used to provide care and assistance for Tahlia over the course of her lifetime.

Medical Negligence Claimant Receives £1.78million

In April 2011 the NHS were also require to pay out a significant sum of compensation when misdiagnosis resulted in horrific consequences for a patient.

In 2003 a doctor decided to give medical advice over the phone instead of making a house call; as a result he failed to diagnose that a two-year-old girl was suffering from septicaemia.

Lydia Cross suffered the amputation of both of her legs below the knee after subsequently suffering from organ failure, a blood poisoning form of meningitis and gangrene.

The claim was settled eight years later and the compensation payment will be placed into a trust fund for Lydia to pay for prosthetic legs, and to help improve her future quality of life where possible.
