Multi Million Pound Damages Awarded for Birth Injury Compensation

Twenty four hour care is now required for a seven-year-old boy, born on 7th September 2004, who suffered brain damage during his birth at Watson General Hospital . Mattia Dessi was starved of oxygen at birth, resulting in permanent brain damage causing Spastic Quadriplegic Cerebral Palsy.

The mother of Mattie, Vivian Dessi, has sued Watson General Hospital for birth injury compensation. Vivian emphasised the lasting damage the brain damage has caused her and her son, advising that Mattie is now confined to a wheelchair and requires round the clock personal care whilst only being able to communicate using his eyes.

Birth Injury Compensation – Awarded

The managers of Watson General Hospital were sued by Mattie through his mother Vivian, with a multi million pound birth injury compensation settlement awarded. Vivian claimed that the delay in delivering Mattie’s birth led to his birth injuries.

The courts heard that the trust had conceded they were liable to pay compensation but still disputed whether the actions of their medically trained staff had factually caused the Cerebral Palsy. Lawyers on behalf of the Trust settled to pay birth injury compensation at 85 per cent of the requested value of the claim.

Mr Justice King approved the settlement stating ‘I have no hesitation in saying that this is a reasonable settlement. The big issue here is causation’.

How Birth Injury Compensation Will Improve Mattie’s Quality of Life

The compensation awarded will be a massive step forward to improving Mattie’s life for his family. The money received will be used to help the family relocate to more suitable accommodation and provide equipment, aids and professional care required throughout Mattie’s life. Mattie will now be able to lead a more adaptable lifestyle with the compensation making financial strains easier.
