A crash survivor has received £100,000 in accident compensation after his microlight fell apart at 1,000ft.

Both Passenger And Pilot Claimed Compensation After The Microlight Accident

Jim Martin miraculously avoided death after the aircraft’s tail snapped off mid-flight, sending the 54-year-old spinning through the air.

The experienced pilot managed to save his own life and that of his passenger, Jon Keer, by navigating the aircraft into some trees at Burgham Golf course in Northumberland. However as a result of the accident both the pilot and the passenger sustained serious injuries.

Mr Martin sustained a brain injury, fractures to both legs and has now been unable to pursue his dream of becoming a commercial pilot. He still suffers from pain as a result of the incident and will require the use of a stick to help him walk for the rest of his life. His passenger, Mr Kerr, sustained a fractured skull, smashed ankles and two broken legs.

Accident Compensation – Microlight Riders Sue Manufacturer

The crash survivors pursued an accident compensation claim against the French manufacturer of the aircraft, Dyn’Aero. They had initially denied liability for the incident but an Air Accidents investigation revealed that bolts used to attach the microlights’ tail-plane to the fin were found to have been corroded. Both men received six figure settlements, with Mr Kerr praising the skill of his pilot:

“This hasn’t been about the money, but about proving that the accident wasn’t our fault. We did everything correctly that day. We could have died. It was only Jim’s skill which saved us.”

A spokesman for the legal team representing the two crash victims commended their fortitude when dealing with such serious injuries. He said:

“Mr Martin and Mr Kerr have shown bravery and strength in the way they have dealt with their very serious injuries. Both have tackled their extensive rehabilitation with courage and have gone on to find alternative employment despite the hurdles their ongoing injuries create.

“They are an inspiration and we are delighted we have been able to achieve this judgement.”
