Work Accident in Dundee Results in £336,000 Fine

Crockett and Partner had been contracted by Electroguard Security Systems as part of another contract with Dundee Cold Stores. Christopher Carson, 23, was an electrician labourer but also a gymnast (and a coach) competing in national competitions.

Carson was using a mobile platform before his work accident, but forgetting some equipment, he went down to retrieve it. On his way down, he accidently stood on a roof light causing him to fall through it before hitting other machinery and landing on a concrete floor.

The fall caused several fractures, a dislocated shoulder and a puncture in his back, caused by drill parts he was carrying at the time. Surgery to reattach three tendons and physiotherapy were required after the work accident.

Work Accident – No Risk Assessment Was Undertaken

Health and Safety Executives discovered that neither of the contractors had asked for a risk assessment concerning Crockett and Partner’s work specific to the work at Dundee Cold Stores, nor did they provide them with information of how it should be safely be competed.

A risk assessment sheet of working at height was provided by Electroguard but workers of Crockett were unaware of this. Failure to provide Crockett’s employee’s with this information may have contributed to the work accident. Working at height was overlooked, thus no risk of falling from a height was reduced. Furthermore, information such as the roof being fragile and safety information were kept from Carson; possibly increasing risks.

Work Accident – The Financial Consequences

At Dundee Sheriff Court, Crockett and Partners were fined £66,000 after a guilty plea of breaching Section 2 of the Health and Safety at Work Act 1974. Electroguard Security and Dundee Cold Stores were fined £135,000 each after a guilty plea of breaching Section 3(1) of the Health and Safety at Work Act 1974 which caused Carson’s work accident.

“Mr Carson has suffered significant and lasting injuries because his employer left him to work at a height unsupervised and without clear instructions about what work he was expected to do and how he was to do it.

”If these companies had thought about the obvious risks involved and planned the work properly then Mr Carson’s injuries, and the impact they have had on his life ever since, could have been avoided.”
