Worker in Railway Accident Claims $4.5 million

Welsh K. Davis, a worker for Norfolk Southern Railroad, suffered a railway accident in 2008 and has successfully claimed $4.5 million in Roanoke Circuit Court as a result.

Welsh tripped on a cross tie, injuring his ankle in the process and the railroad he worked for, Norfolk Southern, have been held responsible by a jury for causing the work accident to take place.

In the Roanoke terminal in 2008, Welsh was walking through the materials yard along the tracks when he tripped on a cross tie. The cross tie had been placed three feet from the tracks, with steel rails stacked on top of it.

He was using a remote control device to couple two freight cars to an engine and had his view of the cross tie obscured by weeds that had been left to grow uncontrollably on the site. Welsh tripped, stepped into a hole in the ground and rolled over on his ankle. The work injury tore a tendon in his right ankle which required two surgeries to put it right.

Railway Accident Led to Complex Regional Pain Syndrome

Since the accident, Mr Davis has been unable to return to work due to the development of complex regional pain syndrome in the aftermath of his recovery. His work injury lawyer, Will Moody Jr. said:

‘’He can barely walk, and when he does it’s with a cane.’’

The jury found that the railroad terminal was in no fit working state and that the weeds should have been cleared during regular maintenance. If this had taken place, Mr Davis would not have suffered the railway accident and be left in a position of being unable to work.

A railway accident that injures a railroad worker is not covered under worker’s compensation in North Carolina and therefore falls under the Federal Employers Liability Act, ensuring that proof of negligence is required before any personal injury compensation can be given.
